These Terms & Conditions apply to all photography services provided by Brümilda Franken Photography. By booking a session, paying a booking fee, or using this website, you agree to the terms below.
1. Booking & Payment
A session is only considered confirmed once the booking fee/deposit has been paid.
The booking fee is non-refundable and secures the agreed date and time. The remaining balance must be paid before or on the day of the session unless otherwise agreed in writing.
Prices may change at any time, but confirmed bookings will honour the price agreed at the time of booking.
Failure to pay the remaining balance may result in cancellation of the session and withholding of images until payment has been received in full.
2. Cancellation & Rescheduling
If you need to reschedule your session, please provide as much notice as possible.
One reschedule may be accommodated at no extra charge where reasonable notice is given. Additional reschedules may incur a fee.
Booking fees are non-refundable in the event of cancellation by the client.
If Brümilda Franken Photography must cancel due to illness, emergency, unsafe weather conditions, or circumstances beyond reasonable control, an alternative date will be offered. If rescheduling is not possible, any payments made beyond the booking fee will be refunded.
Outdoor sessions may need to be postponed due to weather or unsafe conditions. This decision is made at the photographer’s discretion.
3. Photography Style & Editing
By booking a session, you acknowledge that you are familiar with the photographer’s portfolio and editing style.
Images are edited in the photographer’s artistic style and discretion. RAW/unedited files are not supplied.
The final gallery will contain a carefully selected number of edited images. Not every image taken during the session will be delivered.
Minor retouching is included where appropriate. Extensive editing requests may incur an additional charge.
4. Turnaround Time
Editing and delivery times can vary depending on workload and season.
Clients will receive their online gallery within an estimated timeframe communicated at booking. Delays caused by illness, emergencies, or technical issues may occasionally occur, though every effort will be made to deliver images promptly.
5. Digital Files & Printing
Digital images supplied to clients are for personal use only unless otherwise agreed in writing.
Clients may:
Share images online for personal use
Print images for personal display
Store and back up their images
Clients may not:
Edit, heavily filter, or alter the images
Sell the images
Submit images to competitions or publications without permission
Use the images commercially without written consent
Image quality cannot be guaranteed when prints are ordered through third-party labs not recommended by the photographer.
6. Copyright
In accordance with Irish and international copyright law, all images remain the copyright and intellectual property of Brümilda Franken Photography at all times.
Clients receive a personal-use licence only.
The photographer retains the right to use images for:
Website portfolio
Social media
Studio samples
Marketing and advertising
Photography competitions or publications
If you prefer your images not to be shared publicly, this must be requested in writing before your session.
7. Client Cooperation
The photographer is not responsible for missed images due to late arrivals, lack of cooperation, unwilling participants, weather conditions, venue restrictions, or interference from guests.
For child and family sessions, the client understands that young children may not always cooperate fully and that natural, relaxed moments are part of the photography process.
Session outcomes can vary depending on mood, weather, lighting conditions, and participation.
8. Extended Family & Group Photos
Unless specifically included in the booked package, sessions are intended for the immediate household/family only.
For Communion, Christening, or milestone sessions, extended family members are welcome to join briefly for a small number of photographs where time allows. Larger extended family groupings may require additional session time and may incur an extra charge.
9. Safety
The photographer reserves the right to end a session if any person behaves in an unsafe, abusive, threatening, or inappropriate manner.
Clients are responsible for supervising children and pets during sessions.
Brümilda Franken Photography is not liable for injuries, damages, accidents, or loss occurring during the session except where required by Irish law.
10. Image Storage
Final edited galleries are kept for a limited time only. Clients are responsible for downloading and safely backing up their images once delivered.
Long-term archival storage is not guaranteed.
11. Website Use
All content on this website, including photographs, text, branding, and graphics, is owned by Brümilda Franken Photography and may not be copied, reproduced, or used without written permission.
Unauthorised use of images from this website is prohibited.
12. Privacy Policy (GDPR)
Brümilda Franken Photography respects your privacy and handles personal data in accordance with the General Data Protection Regulation (GDPR) and Irish data protection laws.
